By using Gyaale (the marketplace at gyaale.thekloudwiz.com), you agree to these Terms. Gyaale is operated by TheKloudWiz from Accra, Ghana.
1. What Gyaale is
Gyaale is a marketplace that connects you with independent vendors (restaurants, and other categories over time). When you place an order, you are entering into a contract with the vendor for the food (or other goods) — Gyaale facilitates the order, payment, and (where applicable) delivery, but is not the seller of the items.
2. Placing an order
- Prices, availability, opening hours, and delivery areas are set by each vendor and may change without notice.
- An order is confirmed once payment is captured by Paystack. Before that, the vendor isn't obligated to start preparing.
- If a vendor cannot fulfil an order after payment (out of stock, closed, etc.), you'll receive a refund through the same Paystack channel.
3. Payment
Payments are processed by Paystack. Funds settle to the vendor; Gyaale does not hold customer funds.
4. Delivery and pickup
- Pickup orders — you collect from the vendor at the address shown on your receipt. A pickup code on your receipt is used to verify ownership at the counter.
- Delivery orders — the vendor arranges a courier. Delivery fees, ETAs, and coverage are determined by the vendor and may be charged separately.
- Order updates (paid, ready, on-the-way) are sent by email and visible on your tracking page.
5. Refunds, complaints, and quality
Issues with the food itself (quality, freshness, allergens, missing items) are between you and the vendor; please contact them directly using the phone number on your receipt. If you can't reach the vendor or believe the order wasn't handled fairly, email hello@thekloudwiz.com and we'll help mediate.
6. Acceptable use
- Don't place orders intending not to collect or pay.
- Don't use the site to harass vendors, staff, or other users.
- Don't attempt to disrupt the service, abuse APIs, or test for security flaws without authorisation.
We may decline service or block access if these terms are breached.
7. Liability
Gyaale provides the marketplace "as is". To the extent permitted by law, our liability is limited to the amount you paid for the affected order. We are not liable for vendor decisions, food quality, allergens, or third-party courier conduct.
8. Privacy
How we handle personal data is described in our Privacy Policy.
9. Changes
We may update these Terms as the service evolves. Material changes will be highlighted on the site. Continued use after an update means you accept the revised Terms.
10. Governing law
These Terms are governed by the laws of Ghana. Disputes will be resolved in the courts of Accra.
